Agreement to Terms

By accessing or using ONClix ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, do not use the Service.

Description of Service

ONClix provides a performance marketing analytics platform that includes server-side tracking, multi-touch attribution, Conversions API integrations, ad platform data syncing, and related analytics services. The Service is available in Free, Pro, and Enterprise plans.

Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

Subscription and Payment

Paid plans (Pro and Enterprise) are billed monthly or annually. By subscribing, you agree to:

  • Pay all fees associated with your selected plan
  • Provide valid payment information
  • Accept automatic renewal unless you cancel before the renewal date

Annual subscriptions include a discount equivalent to 2 months free. Refunds are handled on a case-by-case basis.

Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Transmit malware, viruses, or harmful code
  • Attempt to gain unauthorized access to our systems
  • Use the Service for competitive analysis or benchmarking without consent
  • Resell or redistribute the Service without authorization

Data Ownership

Cloud-Hosted Users

You retain ownership of all tracking data collected through your use of the Service. We process your data solely to provide the Service and as described in our Privacy Policy.

Self-Hosted Users

For self-hosted deployments, all tracking data resides on your own infrastructure. You are fully responsible for the security, backup, and compliance of your self-hosted data.

Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice. We are not liable for downtime caused by factors beyond our control.

Intellectual Property

The Service, including its software, design, logos, and documentation, is owned by ONClix and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service.

Limitation of Liability

To the maximum extent permitted by law, ONClix shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be error-free, secure, or meet your specific requirements.

Termination

Either party may terminate the agreement at any time. Upon termination:

  • Your access to the Service will be suspended
  • Cloud-hosted data will be retained for 30 days, then deleted
  • Self-hosted data remains on your servers
  • Outstanding fees remain payable

Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or notice on our website. Continued use of the Service after changes constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by the laws of the jurisdiction in which ONClix is incorporated, without regard to conflict of law provisions.
